One of the main tenants' organizations has come out against the government's proposed Law on the Inviolability of Private Property . The group warned that the initiative proposes a scheme of " rapid evictions " unprecedented in the region.

The project establishes the most aggressive eviction regime in Latin America ,” asserted Gervasio Muñoz, a leading figure in the Tenants' Union, after a comparative analysis with legislation from countries such as Brazil, Uruguay, Peru, Spain, El Salvador, and Paraguay. According to the organization's report, no other country combines such short eviction periods with such a low level of guarantees for tenants .


The initiative, promoted by the Executive Branch and presented on March 27 , began to be debated last Wednesday in a joint committee meeting in the Senate, although the ruling party stated that there will be no report until at least next week. The initiative was spearheaded by the Minister of Deregulation and State Transformation, Federico Sturzenegger .

The objective, according to the document, is: “ To eliminate illegitimate restrictions that limit the essential content of property rights , strengthen their protection, and further promote legal certainty.”

The initiative proposes a comprehensive reform that includes changes to the expropriation regime , modifications to eviction processes , and adjustments to various laws , including those concerning rural land, fire management, and the socio-urban integration regime for low-income neighborhoods.

One of the central points of the project has a direct impact on evictions , seeking to make them faster and simplifying registration procedures.

What does the bill propose regarding evictions?​

The text of the project establishes that all processes , both for non-payment and for intrusion or seizure of real estate, will be processed through summary proceedings , the fastest procedure in the Argentine judicial system.


To that end, the reform modifies articles of the National Code of Civil and Commercial Procedure, which governs exclusively in the city of Buenos Aires, as well as the National Civil and Commercial Code , which is a substantive law applicable in all provinces . The main proposed changes focus on the following points :

  • The summary trial is implemented : it establishes that all processes, both for non-payment and for intrusion or seizure of real estate, will be processed through summary trial, the fastest procedure in the Argentine judicial system.
  • The payment notice is for three calendar days : in case of non-payment of rent, the owner must send a notification granting a period of three calendar days for the tenant to pay the debt (currently it is 10 days).
  • Restitution can be expedited in cases of trespass (situations where people have entered or remain on a property without the owner's permission): the judge can return possession to the owner before the final judgment is issued. The bill specifies that this can be requested once the lawsuit has been officially served. That request must be resolved within five days.
  • Restitution can also be expedited in cases of non-payment or expiration of a rental agreement : the plaintiff must present a sworn guarantee (a legal commitment to take responsibility for possible damages, i.e., how they receive it) and the procedure will follow the fast-track deadlines of the summary trial.
  • Evidence to be presented in trials is limited : in parallel, in trials based specifically on non-payment or expiration of term, only documentary and expert evidence will be admitted, with the aim of avoiding delays associated with other means of proof.
For the group, this combination represents a change in the rules that decisively tips the scales in favor of the landlords . This is primarily because there is no "second chance": the possibility of halting the eviction by paying the debt is not considered.

“The government wants a law passed that would immediately evict a family if they are three days late in paying their rent,” Muñoz said.

But the questioning of this law, which according to Muñoz will be approved, is not limited to the legal level, but links the project with the economic context and the current dynamics of the rental market .

According to their view, a "lethal combination" is being created for tenants : shorter contracts, more flexible conditions for landlords, and a deterioration of real income in a scenario of greater job insecurity.


At the same time, he anticipated a regulatory back-and-forth scenario : "When this generates consequences, another government will have to push for a rental law again."

While the government is betting on accelerating evictions as a signal to landlords, tenants warn that the social cost could be immediate.
