In a context where mortgage loans have reappeared as a tool for financing property purchases , many are wondering what real estate purchase transactions are like. Among the questions that arise is who is responsible for paying the fees and what percentage of the property's value they represent .
Indeed, demand for property remains high. Analyzing the latest figures for the Autonomous City of Buenos Aires (May), deeds show a 22% year-over-year increase in the number of purchase and sale transactions. Mortgage transactions also increased, with 1,300 mortgages signed , an 822% increase compared to the same month last year.

" We've achieved three consecutive years of year-over-year growth , that is, 36 months of uninterrupted positive growth. Another encouraging fact is that credit transactions are increasing a little every month," emphasized Jorge De Bártolo, president of the Buenos Aires Notaries Association. He added: "We believe it's preferable to continue growing like this, with a more stable dollar environment, where people see that it's possible to pay a mortgage payment."
In the case of rental housing, it's worth noting that in Buenos Aires, as a result of Law 5859, implemented during the Rodríguez Larreta administration, real estate agents cannot charge fees to tenants; only the owner pays 4.15%.
However, in the case of commercial rentals, such as offices, retail stores, warehouses, among others, the owner must pay between 3% and 5%, while the tenant pays 5% (plus VAT, if applicable).

Who authorizes a real estate agent to work?
Today, anyone who wants to work as a real estate broker must complete a degree —which in some provinces is a university degree and lasts more than four years— and, once graduated, obtain a license and pay the association a fee (annually or as a percentage of transactions) to be able to practice the business . Those responsible for granting the license are the real estate associations or associations of auctioneers and public brokers, which are approved by the local governments of each jurisdiction in which they operate. For example, in the Province of Buenos Aires, there are 21 associations in different judicial departments, and in the rest of the country, there are between 17 and 18 associations spread across the 24 provinces, although not all have one.In addition to authorizing real estate agents to work, the associations are responsible for ensuring that the real estate agencies they operate have the necessary licenses and training to practice their profession.
