On December 29, 2023, when Javier Milei's Decree of Necessity and Urgency (DNU) came into effect , the rental law was repealed , and with it, lease agreements once again became governed by the Civil and Commercial Code with some modifications , as they were before June 2020, when the controversial law was enacted. From then on, the terms of new agreements are established by mutual agreement between the parties.
This means that contract terms can be negotiated: there is no legal minimum term, but if this is not specified, it will be two years. Another change is that rent adjustments can be agreed upon , and any index, public or private, expressed in the same currency as the original contract, can be used . The frequency of these adjustments must also be agreed upon; quarterly or four-monthly adjustments are the norm.

To simplify the calculation of each index , a website has been available since 2020 that allows users to easily and quickly calculate the adjustment amount for rental contracts . “The idea for the platform arose from the difficulty anyone unfamiliar with the data for each index faces when performing the calculations,” explains Juan Martín Pagella, creator of Arquiler .
Arquiler is a rental calculator that emerged from the idea of having a tool at hand to facilitate the calculation of updates to rental contracts.
“The veracity of the results can be corroborated because we use all official publications when they publish each index,” says Juan Martín Pagella, creator of the Arquiler platform.
The data sources used are: ANSES for calculating the CPI; the BCRA for the ICL and the CER; the Argentine Chamber of Construction for the CAC Index; and the Secretariat of Territorial Development, Habitat and Housing for the Casa Propia Index. According to the data provided by the platform, the most commonly used indices today are the ICL (contracts still in force under the repealed law) and the CPI.

Possible indices to consider in a rental agreement
Among the variety of existing public indices that could be applied to lease agreements, there are different options, some developed by INDEC (National Institute of Statistics and Censuses) and others by the Central Bank (BCRA). Below is a description of what each one weighs:INDEC
- CPI (Consumer Price Index): measures the change in prices of goods and services representative of household consumption expenditure compared to prices in the base year. Real estate brokers agree that the landlord's goal with the adjustment is to keep pace with inflation . "Today, they prefer pesos with quarterly CPI adjustments, and tenants are accepting this without conflict," adds Daniel Salaya Romera, owner of the eponymous real estate agency.
- Wage Index: This index tracks monthly wage variations in both the public and private sectors. “This index could be used as a good indicator because, in the long term, even though we are currently at a very low wage level, on average wages and inflation move in tandem, and at some point they will have to recover,” says Federico Gonzalez Rouco, an economist at the consulting firm Empiria.

- The ICL (Rental Contract Index) takes into account inflation (according to the INDEC CPI) and wage variations, based on the average remuneration of stable workers (RIPTE). It is used to calculate rent increases under the rental law passed in 2020. “Just like with the Home Ownership Index (used as an indicator for rent increases under the Law's update starting in October 2023), I don't think they will be used, because they have a very bad reputation after the repeal of the regulations and because they fall below inflation and market prices,” says González Rouco.
- Reference Stabilization Coefficient (BCRA) : This is a daily adjustment based on inflation. "UVA, inflation, and CER do not show significant differences from one another," adds González Rouco.
- UVA (Purchasing Power Unit) : In this case, the calculation is simpler, "because if the contract is valued at -for example- 1000 UVAs, each time there is an increase it will be based on 1000 UVAs; you just have to see how much it increased in that period. I don't think it's a minor variable because the ease of calculation, in this context, is very important," explains the economist.
