Currently, three contracts coexist, but one type no longer receives any increase.

In the last month of the year, existing rental contracts face another increase in their monthly rent. It's important to clarify that the increase will depend on the type of contract signed, as three types of contracts are currently in effect : those signed under the original rental law, those signed with its updated terms, and those agreed upon after the law's repeal.

The characteristics of each modality are as follows:



  • Those that were signed under the rental law: have annual adjustments by the Rental Contract Index (ICL).
  • Those who did so after the update of the regulations -in October 2023-: with semi-annual adjustments for Home Ownership.
  • Those that were agreed upon after the repeal of the law - on December 29, 2023 - with contractual freedom between the parties.




But, as was the case last month, the impact will be less: only those agreements signed under two current modalities will be updated , since contracts under the old rental law - even though many are still in force - and with adjustments by ICL will no longer receive increases given that the ICL as an index imposed by the law was only present until October 2023. After that, the contracts were made with Casa Propia (October to December 2023) or with IPC (December 2023 onwards).

Which contracts are updated in December​

In this context, the contracts that will receive increases this month are the following:



  • Those signed in December 2023 under the updated law , with semi-annual adjustments for Casa Propia .
  • Those signed from December 29, 2023 onwards , after the repeal of the law, with quarterly or four-monthly adjustments according to the CPI .


Meanwhile, contracts signed under the old law , with a three-year duration and annual updates by ICL, no longer reflect increases because, starting in October 2023, they began to be signed with Casa Propia (this modality expires in October 2025), and now there is contractual freedom. Those that were updated last October will definitively end in 2026.





Increase due to CPI​

From December 29, 2023 , with the repeal of the rental law, contracts began to be freely negotiated between the parties . This means that landlords and tenants can freely agree on the contract duration, the frequency of adjustments, and the index to be used.



In most cases, the agreements include quarterly or four-monthly updates based on inflation, as measured by the Consumer Price Index (CPI) .



Thus, for those who signed contracts with quarterly adjustments, the December increase will be calculated using the latest index published by INDEC (October 2025), resulting in a 6.43% increase . In concrete terms: if the rent is $600,000 , the new amount to be paid will be approximately $638,556.58 . Meanwhile, if the rent is $800,000 , the new amount will rise to $851,408.78 .

Owning Your Own Home​

It's important to clarify that contracts signed under the Casa Propia index represent a small portion of the agreements, as this system was in effect from October 18 to December 29, 2023. Therefore, contracts signed under the Casa Propia index will receive their fourth increase, with a 21.69% adjustment. This means that if the rent started at $200,000 in 2023, with this new increase it will rise to $915,316 .





By ICL​

It's important to clarify that, since contracts are currently negotiated freely, agreements can still be finalized with adjustments based on the ICL (Consumer Price Index) if the landlord and tenant chose that index, but the annual adjustment obligation stipulated by law is no longer in effect . Therefore, those who receive the December increase—with quarterly adjustments—based on this index will see a 6.01% rise .





What happens to contracts that expire?​

In December, contracts will also end; these are the ones that were agreed in the same month of 2022 and signed under the rental law: for three years and with annual adjustments under the ICL .

Now, the market landscape is different : the vast majority of rental contracts are now negotiated freely between the parties , for two years with adjustments every three or four months , in pesos and tied to inflation . Therefore, both tenants whose agreements are ending and those who have chosen to continue them will have to agree to the new contract under these conditions.





However, a key point to consider is that the prices currently listed on the market tend to be lower than the prices tenants pay under their contracts. This is because a gap emerged between the ICL adjustment and the rental prices of new contracts, although this gap has narrowed due to the slowdown in inflation.



Meanwhile, current listing prices are above inflation: in the last 12 months, the value of new contracts has accumulated a 35.6% increase , a percentage above the inflation rate, which soared to 31% during the same period, but below the ICL adjustment (40%), the Central Bank index used to adjust increases in contracts signed under the old law. These figures were reflected in Zonaprop's latest report from November.
