Residents of the City will be able to complete the home protection process free of charge and receive notarial advice on inheritances, donations, and cohabiting unions.





The Buenos Aires City Notary Association will hold another free consultation session this Saturday as part of its "Protect What's Yours" campaign, now in its 16th year. The event will take place between 10:00 AM and 1:00 PM at the association's headquarters located at Avenida Callao 1540, in the Recoleta neighborhood, and is open to the public without prior appointment.



The goal is to provide reliable legal information and streamline procedures that, under normal circumstances, involve notary fees. Residents will be able to receive guidance on buying and selling real estate, donations, inheritances, advance healthcare directives, powers of attorney, and especially on the housing protection system, one of the most requested resources in previous editions.



During the day, the procedure for registering the property under the housing protection regime , which replaced the old "family property" system as of the Civil and Commercial Code of 2015, can also be carried out free of charge.



This legal mechanism protects the family property from debts incurred after its registration, reinforcing the financial security of its inhabitants.





Personalized

The notaries will provide personalized advice on:

• Buying and selling properties , in a context of market reactivation and new lines of credit.

• Inheritances and successions, with guidance on documentation and procedures.

• Donations, their legal scope and validity in family transactions.

• Powers of attorney and advance health directives, notarial instruments for planning future decisions.

• Housing protection scheme, free procedure during the day.

These actions are part of a legal prevention policy that seeks to avoid legal conflicts and promote informed decisions about assets and family.

The legal protection process prevents a property from being seized or foreclosed upon for debts incurred after registration. It benefits the owner, their spouse or partner, and their cohabiting relatives, within the degrees of kinship permitted by law. The measure does not cover prior obligations or those directly related to the property, such as maintenance fees, taxes, mortgages, or building improvement contributions.

The notaries explain that this instrument applies to houses, apartments, townhouses, garages, or storage units if they are in the same building or lot. It can also include dwellings built on adjacent lots. Outside of the free service period, the procedure has a base cost of $160,000 plus administrative fees of approximately $20,000.

Registration does not require the mortgage lender's consent, even if the property is already subject to a loan. Furthermore, it protects the residents from unforeseen financial difficulties or future financial obligations.





Conferences

The day will include two conferences with practical guides and topics of high demand. At 10:30 a.m., a presentation titled “Decide Today What Matters Tomorrow” will be given on advance healthcare directives, a legal instrument that allows individuals to express in writing how they wish to be medically treated should they become unable to make decisions in the future. This tool avoids legal proceedings and makes it easier for a family member or legal representative to manage the person's assets or resources if it becomes necessary to cover expenses such as hospitalization or nursing home care.



At 11:30 a.m., the session “Married, Cohabiting, or Confused?” will address the legal differences between marriage and cohabitation, property regimes (community property or separate property), and the rights of cohabiting partners in the event of death. It will explain how to register the union and what effects this has on shared assets, pensions, and inheritances.



The College of Notaries has been running the "Protect What's Yours" campaign for over a decade to democratize access to legal information. Consultations are free and confidential, and no prior documentation is required. This year's campaign will focus on preventing family and property disputes, providing advice on mortgage-related procedures, and guiding those seeking to regularize their housing situation.







Objectives and federal day

The initiative's objectives include expanding knowledge about property and inheritance rights, promoting preventive protection of family homes, encouraging informed decision-making regarding health and coexistence, and reducing litigation through accessible notarial instruments.



The 2025 edition coincides with the XIII Federal Conference on Community Notarial Advice, organized by the Federal Council of Argentine Notaries, which replicates similar activities in different notary associations throughout the country. In the current context, with the return of mortgage lending and an expanding real estate market, inquiries are increasing regarding the documentation required for deed registration , property tax implications, and donations. Notaries in Buenos Aires emphasize the importance of understanding these procedures before signing a transaction or assuming financial obligations.



The campaign will continue in other districts of the city over the coming months, with new events open to the public. Each event will include personalized service, free procedures, and talks on topics of interest to residents. The institution emphasized that the main goal is to bring notary services closer to the community, promote legal security, and offer preventative legal tools that allow families to protect their assets with clear information and direct advice.



“People need to know their rights and how to protect their assets before conflicts arise. That is legal prevention, and it is our role to promote it,” the College concluded.
